Welcome to Morocco Get Your Guide. These Terms and Conditions (“Terms”) govern your use of our website [https://moroccogetyourguide.com/] (the “Site”) and your booking of our travel services, including tours, excursions, day trips, and related travel arrangements (collectively, the “Services”) provided by Morocco Get Your Guide (“we,” “us,” or “our”).
By accessing our Site or booking our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or Services.
1. Booking and Reservation Process
- Booking Confirmation: A booking is only confirmed and a contract formed when we have received your required deposit or full payment, and we have sent you a written confirmation (via email) detailing your itinerary and booking reference.
- Accuracy of Information: You are responsible for ensuring that all information provided during the booking process (names, dates of birth, passport numbers, contact details, special requirements) is accurate and complete. We bear no responsibility for errors or delays caused by incorrect information.
2. Pricing and Payments
- Tour Prices: All prices are quoted in the currency specified on your booking confirmation. Prices include the elements explicitly stated in the itinerary. Unless stated otherwise, prices do not include personal expenses, tips, meals not specified, travel insurance, or entrance fees to monuments/museums unless noted.
- Deposits: A non-refundable deposit (typically a percentage of the total tour cost, as specified on your invoice) is required to secure your booking.
- Final Payment: The remaining balance must be paid prior to the start of the tour, or as specifically agreed upon in your booking confirmation. Failure to pay the balance on time may result in the cancellation of your booking without a refund of the deposit.
- Payment Methods: We accept payments via bank transfer, credit/debit card, or other methods specified on our website or invoice.
3. Cancellations and Refunds by the Client
If you need to cancel your booking, you must notify us in writing (via email to contact@moroccogetyourguide.com). The cancellation will take effect from the date we receive your written notice. Cancellation charges will apply as follows, unless otherwise stated in your specific itinerary agreement:
- 30 days or more before departure: Loss of initial deposit.
- 15 to 29 days before departure: 50% of the total tour cost.
- 14 days or less before departure / No-show: 100% of the total tour cost.
- Note: Any non-refundable costs incurred by us on your behalf with third parties (e.g., non-refundable flights, luxury desert camps, special train tickets) will be deducted from any potential refund.
4. Amendments by the Client
If you wish to amend your booking (e.g., change travel dates, alter the itinerary) after it has been confirmed, we will do our best to accommodate your request. However, amendments are subject to availability and may incur additional fees charged by our suppliers. An administration fee may also apply.
5. Alterations and Cancellations by Morocco Get Your Guide
- Itinerary Changes: We reserve the right to alter your itinerary before or during your trip due to unforeseen circumstances (e.g., severe weather, road closures, safety concerns, or changes to flight/train schedules). We will always endeavor to provide a suitable alternative of equal value.
- Tour Cancellation: We reserve the right to cancel a tour prior to departure due to insufficient bookings, force majeure, or safety concerns. In the event of cancellation by us, you will be offered a full refund of all monies paid, or the option to transfer your booking to an alternative tour/date. We will not be liable for any additional expenses incurred (e.g., flights, visas).
6. Travel Insurance
Travel insurance is mandatory for all clients booking multi-day tours and highly recommended for day trips. You must arrange your own comprehensive travel insurance to cover cancellation, medical expenses, personal injury, repatriation, loss of luggage, and personal belongings. We are not a licensed insurance provider and accept no liability for any losses not covered by your own insurance policy.
7. Health, Fitness, and Responsibilities
- You are responsible for assessing whether you are physically and mentally fit enough to participate in the chosen tour.
- If you have any pre-existing medical conditions, disabilities, or dietary requirements, you must inform us in writing at the time of booking.
- You must comply with all local laws and regulations in Morocco. You must also follow the reasonable instructions of our guides, drivers, and representatives at all times.
8. Conduct
We reserve the right to refuse to carry any person, or to cancel the remaining portion of a tour for any person, whose behavior is deemed to cause distress, danger, or annoyance to other clients, our staff, or third parties. In such cases, no refund will be given for the unused portion of the tour, and we accept no liability for any additional costs incurred.
9. Limitation of Liability
- Third-Party Services: We act as an intermediary between you and various third-party service providers (hotels, transport companies, restaurants, local guides). While we carefully select our partners, we do not own or control them. We are therefore not liable for any death, personal injury, illness, loss, or damage caused by the act, omission, or default of these third-party providers.
- Baggage & Valuables: You are solely responsible for your personal belongings, baggage, and valuables at all times. We will not be held liable for lost or stolen items.
- Indirect Damages: To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with our Services shall not exceed the total amount you paid to us for the specific tour in question. We shall not be liable for any indirect, incidental, or consequential damages.
10. Force Majeure
We shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control (“Force Majeure”). This includes, but is not limited to: natural disasters, pandemics, epidemics, wars, terrorism, strikes, civil unrest, government actions, or extreme weather conditions.
11. Complaints
If you have a complaint during your tour, you must inform your local guide or our office immediately so that we have the opportunity to resolve the issue on the spot. If the issue cannot be resolved, any formal complaints must be submitted in writing to contact@moroccogetyourguide.com within 7 days of the completion of your tour. We cannot accept liability for complaints made after this period.
12. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Morocco Get Your Guide and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use this content without our prior written permission.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the competent courts in Marrakech, Morocco.
